Kitui County MCA Cyrus Kisavi Musyoka has denied stealing 42 mobile phones valued at KSh609,000 in a case before the Milimani Law Courts in Nairobi.
Musyoka, who represents Ikanga/Kyatune Ward, appeared before Principal Magistrate Geoffrey Onsarigo on Tuesday, November 3, 2026, where he pleaded not guilty to the charge.
According to the charge sheet, the Director of Public Prosecutions (DPP) alleges that the MCA stole 42 Itel City 200 mobile phones from Yare Parcel Office along Luthuli Avenue in Nairobi on August 5, 2026.
Each phone was valued at KSh14,500, bringing the total value of the consignment to KSh609,000. The property is listed as belonging to Dahir Adan Mohamud.
The charge was brought under Section 268(1), read together with Section 275 of the Penal Code.
Following the plea, Musyoka’s lawyer asked the court to grant him reasonable bail and bond terms as the case proceeds.
However, the prosecution opposed his release, telling the court that the accused had previously failed to attend court proceedings in another criminal matter.
The prosecution referred to a case previously handled at the Makadara Law Courts, identified as E5813 of 2024. It told the magistrate that a warrant of arrest had been issued after Musyoka allegedly failed to appear.
The prosecution also said it had provided copies of the warrants alongside an affidavit from the investigating officer in support of its objection to bail.
According to the investigation account presented in court, the earlier case was withdrawn after the MCA allegedly absconded. The matter was later reinstated under a new case number, E2893 of 2025.
The prosecution further alleged that Musyoka failed to attend court again and remained unavailable until his arrest on October 22, 2026.
The MCA had reportedly spent seven days in custody following an earlier order by Principal Magistrate Paul Mutai, who had directed that he be detained for seven days as investigations continued.
The latest court appearance now places the matter at the plea stage, with the prosecution and defence presenting their respective positions on whether he should be released on bail or bond.
Musyoka has denied the current theft charge, and the allegations remain subject to determination by the court. The prosecution’s claims about his previous court appearances are also matters presented for consideration in the proceedings.
